RULES AND REGULATIONS
Revised March 2007

The following is a list of rules and regulations which are deemed necessary for the safe and satisfactory operation of our pool. We would ask that you and each member of your family make every effort to comply with these rules to ensure everyone’s safety and enjoyment of the pool.  Failure to comply with these rules may be grounds for suspension of pool privileges at the discretion of the Board of Directors.

ARTICLE I- SCHEDULE
1. The date of pool opening and closing, as well as pool hours, will be published in a newsletter prior to opening day.

ARTICLE II - ADMITTANCE OF MEMBERS
1. All members will pay annual dues of $300 per year.  Annual dues cover a member or member family which is defined as the head(s) of the household and all dependents. 

2. New Members:  New members are welcomed to join at any time.  People joining for the first time before July 15th will pay the $300 annual fee plus a one time registration fee of $75.  After July 15th, first time members will be allowed to pay half the annual dues ($175) plus the $75 registration fee.  All members will be allowed to waive the $400 stock option until their second season.

3. Returning Non-Stock Members:  Members who have paid for part or all of one season will be required to purchase the $400 stock option in their second season which is refundable upon resignation.  Non-stockholding members renewing membership for a second year must pay their annual dues of $300 plus the stock option of $400 by May 1.  Members may choose to pay this in one payment or divide the $700 payment into, at most, 4 payments of $175 each. Which ever payment method the member chooses, payment in full must still be received by May 1. After May 15 a $25.00 late fee will be applied.

4. Returning Stock Members:  Members who have already purchased the stock option will pay the annual dues of $300 by May 1.  A late fee of $25 will be applied after May 15.  Stock members will be allowed to pay one half the annual dues if they will be resigning from the pool by July 15th.  However, the member must notify the membership chairman of this decision upon payment of annual dues; otherwise they will be liable for full payment and the late fee.  Stock members who wish to resign from the pool must notify the membership chair in writing of their intent by May 15 (see “Resigning Members” below).  Stock holders may also choose “Inactive Status” (see below).

5. Senior Members:  Members who are 60 years of age or older by May 15th and who have been stockholders for at least 5 years may request in writing to the Board by May 15th a change in status to senior member.  Dues for senior members are half the annual dues.  If the stock is held jointly in the husband’s and wife’s names, the older spouse must be at least 60 to request senior membership.  Only the husband and/or wife will be eligible.  No children, grandchildren or others from the household of the senior will be allowed this option.

6. Inactive Members:  Current stockholders who will not be using the association facilities for the year may elect an inactive status by paying a $50 inactive fee. The member must notify the membership chair of this change and pay the fee by May 1st.  A member may not elect inactive status after May 15th and will be responsible to pay the annual fee in full, plus the $25 late fee.

7. Resigning Members:  Current stock members who wish to resign their membership must notify the membership chairman in writing by May 15.  Members in good standing (accounts paid in full) will receive their $400 stock option back.  Any delinquencies in a member’s account will be deducted from the $400 and the remainder will be sent to the member.  Any members not notifying the membership chairman about their intent to resign by May 15 will be liable for the annual dues and late fee for that season.  If this is not paid it will be deducted from the stock purchase when the member does resign.  The Windy Point Pool Board will send out refund checks within one year.

 
  8. Delinquent Accounts:  Any member whose account is in arrears will not be allowed access to the pool, facilities, or programs until the account is settled.

9. All members will be assigned a membership number and must sign in using this number as they enter the gate.

10. All correspondence should be sent to the appropriate officer at Windy Point Recreation  Association, P. O. Box 1377, Yorktown, Virginia 23692.

11. The swim team shall be made up of only those who have the privileges of membership in the  Association.


ARTICLE III- ADMITTANCE OF GUESTS
1. Guests
a. Guests must be accompanied by a member 15 years or older. Members are responsible for their guests at all times.
b. Members must sign their guests’ names in the guest register.
c. Guests are subject to the same rules as members.
d. Guests may be refused admittance by the management for just cause.
e. Each family may purchase an unlimited number of guest passes for $5.00 each or 10 passes for $35.00. A non-member, visiting the pool as a daily guest, may use the facilities a maximum of 15 times per season.
f. Special houseguest passes for out of town guests may be obtained at the gate. The costs of houseguest passes are $20.00 per family per week. Local guests may be issued houseguest passes at the discretion of the pool manager if they are temporarily residing with a member.
g. Non-member childcare givers, who are employed by members on a continuing basis, may be admitted to the pool, without guest fees, while attending members’ children. Childcare Givers must be 15 years old or have a Red Cross Childcare Certification. Non-member Childcare Givers may not bring guests to the pool. The families of non-member Childcare Givers have no pool privileges. It is the responsibility of the Childcare Givers to supervise, at all times, the child/ren to whom they are being paid to care for.
h. Members who are employed on a continuing basis as babysitters of non-member children may bring these non-member children as guests. Members will be charged the least of $5/child/day, $15/week, or $50/season.
i. Member grandparents who are not Senior Members are permitted to bring local non-member grandchildren without paying guest fees. Non-member grandchildren will not be admitted to the pool unless accompanied by a member grandparent.
j. Foreign exchange students residing with a member family will be admitted free of charge.
k. Employee’s families may not use pool facilities unless they are members of the pool. Non-member employees may not sponsor guests.

2. Spectator guests:
a. Must be at least twenty-one (21) years of age.
b. Must attend as a spectator only.
c. Must be accompanied by a member.
d. Must be signed in the spectator register by the member.
e. Are admitted with no fee.
f. Are subject to the same rules as members.
g. May be refused admittance by the management for just cause.

3. MEMBERS FALSIFYING THE NAME AND/OR ADDRESS OF ANYONE IN ORDER TO BRING SAID PERSON IN AS A GUEST MAY LOSE THE USE OF THE POOL FOR THE REMAINDER OF THE SEASON.
4. Admittance at swim meets:
a. Members, members’ guests, participating teams and their guests will be admitted.
b. Signing of the guest register and fee are not required.
c. Pool rules and rules adopted for specific meets will apply.
d. Time of admittance will be set by the pool management.
e.   The management may refuse admittance for just cause.

ARTICLE IV- GENERAL OPERATION OF THE POOL AREA
1. The pool manager and lifeguards, on duty, shall have full authority to enforce all rules of the pool. Any criticism of the lifeguards shall be directed to the pool manager. Criticisms of the pool manager shall be directed to the Board of Directors.

2.  Children 10 years and under are NOT permitted in the pool after 6:00pm unless accompanied          by a member 15 years or older.  Swimmers who are deemed unsafe in the water may be  requested by the lifeguard to swim the length of the pool to prove their ability or may be asked to           exit the pool. The manager/assistant manager must be notified if the latter occurs.

3.  Any person acting in such a manner as to endanger him/herself or infringe on any other person’s                    rightful enjoyment of the pool and surrounding grounds, in the opinion of the manager or lead             lifeguard, will receive an initial warning. A second offense will result in a 10 minute timeout. A  third offense will result in loss of pool privileges for that day. For minors, parents will be notified by  the Board of Directors about the action.
 
4.  Pets will not be allowed inside the gate and should not be encouraged to remain at the gate where they might slip in.

5. Anyone showing signs of intoxication will be refused admittance or required to leave.

6. Any damage to the Windy Point property caused by members or their guests may be charged to the member involved. Intentional damage to association property, in the opinion of the manager, will result in a minimum penalty of automatic suspension of pool privileges for two weeks, repayment for the cost of repairs, and may result in more severe sanctions as determined by the Board of Directors.

7. Persons with open sores, discharge from nose or ears, or contagious conditions may not enter the pool.

8. All trash and litter must be placed in cans provided.

9. All unauthorized persons shall stay clear of the lifeguard stand and avoid diverting the attention of the lifeguards from their work.

10. The association does not assume responsibility for the loss or theft of personal articles within the  pool grounds. All persons are asked to keep their personal belongings to a minimum while using  the pool.
 
  11. Smoking is not allowed in the pool area or the clubhouse.
12. Member’s personal property shall not be kept in the storage area, snack bar, picnic tables, or bathrooms. Racks along the fence can be used to keep deck clear.

13. No glass containers will be permitted in the pool area except those necessary for the operation of the pool.

14. Consumption of food and beverages, other than water, shall be confined to the grassy area.

15. Use of the pool telephone will be limited to three minutes.

16. Preference is to be given to persons 18 years of age and older for the use of the pool-owned chairs.

17. The use of clothing which, in the opinion of the manager, is subject to shredding or unraveling such as “cut offs” is not allowed in the pool. Anyone seen wearing such attire will be refused admittance in the pool.

18. The addition or deletion of rules may be made at any time as the Board of Directors entertains members’ suggestions as to the merit or necessity to provide a safe and enjoyable environment.

ARTICLE V - OPERATION OF THE MAIN POOL
1. Swimming is allowed only when at least one lifeguard is on duty at poolside. (If there is no lifeguard on duty during pool hours, please notify the manager.)

2. All swimmers should take a cleansing shower before entering the pool.

3. Water-wings, pool noodles, and blow-up floats are NOT approved personal flotation devices. They are toys and not meant to protect a child from harm while in the water. Any non-swimmer or weak swimmer even if they are using/wearing approved or not approved a flotation-type devise must be DIRECTLY SUPERVISED (within arms’ reach) while in any part of the pools by a responsible person aged 15 or older and preferably the parent or guardian. Any non swimmer or weak swimmer that is not being directly supervised, within arms’ reach, will be instructed to exit the pool until such time as a responsible person aged 15 or older is able to be with them.
Anyone using or wearing approved or not approved flotation-type devices may NOT use the  diving boards.

4. Floats used in the lap pool for recreation are dependent upon lifeguard approval.

5. Only one person on each diving board at a time. A diver on the board must wait until the previous diver has resurfaced and cleared the area below the board. Divers must take off from the end of the board only. No diving will be permitted off the sides of or between the boards. Excessive bouncing on the board is prohibited.

6. COURTESY and CONSIDERATION of others are cardinal rules for the satisfactory use of any pool. The following is a list of “Don’ts…There are others, but, if in doubt, DON’T!
a. spout water, blow nose, expectorate, etc. into the pool.
b. run, trip, or wrestle on the concrete area of the pool or anywhere on Windy Point property.
c. dunk or dive too near other people.
d. Members are encouraged to report any infractions of the rules and discipline problems to the pool manager.

7. In case of emergency or for control purposes, the pool may be closed at any time at the discretion of the management.

8. All persons using the pool and facilities of the Association do so at their own risk. The Association is not responsible for any accident or injury in connection with such use.

9. MEMBERS WILL USE EVERY CAUTION UPON ENTERING AND LEAVING THE POOL AREA. SPEED LIMITS ARE POSTED AND WILL BE STRICTLY ADHERED TO.

10. All persons under 16 years of age will be required to leave the pool for a ten-minute rest period each hour.

ARTICLE VI-OPERATION OF THE WADING POOL
1. Children over 6 years of age are not allowed in the wading pool
2. Parents, adults, or Childcare Givers must remain in the wading pool area with their children.
3. Children in diapers are not permitted in either pool without vinyl pants or swim diapers.
4. Article V Number 3 and 6 also apply.
